FOX's Glenn Beck, It looks like the same sex couples of California may yet still get the right to marry. The California Supreme Court has agreed to take up the case of whether or not Proposition 8 (ban on gay marriage) is constitutional

Since November 4th, the issuing of marriage licenses to same sex couples has been suspended. Opponents of proposition 8 argue that such a substantial change in the state's constitution must be done through legislature action. Supporters have countered by claiming that the "will of the people must be upheld."

The legality of the 20,000 marriages already enacted is also up for consideration by the court. Essentially, those who have already been married will have that marriage overturned. Interestingly, Republican Governor Arnold Schwarzenegger has claimed that the current marriage licenses given should stand.

Personally, this seems like a clear cut case to me. The idea of a majority deciding on the rights of the minority seems absurd. Who are we to decide the rights of anyone else? Historically, the courts have always decided and protected the rights of minorities. Hopefully, the same will happen in California.

  • Do you know the difference between a Democracy and a Republic ? I'm sure you've been lead to think America is a Democracy. And the "will of the people" is what makes our laws. But that's not true. America is a Constitutional Republic. Remember the Pledge of Allegiance ? The difference is, in a representative Republic the rights of the minority are preserved and can't be voted away by the majority. Because guess what happens in a Democracy when two wolves & one sheep vote on what's for dinner ?

    But I do agree with you on the part about marriage and Christianity. Christianity's claims on marriage are unjustifiable and flat out laughable!

  • If we put Churches "tax exempt" status up for popular vote, they wouldn't stand a chance...they are sitting on BILLIONS of dollars worth of untaxed property and holdings yet are willing to enter into political policies....they would NOT survive a public vote. Maybe it's time we treated them as they treat others?

  • The attempt by anti-gay forces to throw out the ruling that overturned the anti-gay marriage law has failed. The judge ruled that being gay himself doesn't create a conflict of interest when a judge rules on gay marriage laws. It's only a matter of time before all anti-gay marriage laws are declared unconstitutional.
