How much do they want for it? The domain has a value to you, but they cannot expect more than a fair market price.

No. They aren't using the domain to profit off any trademarks you own so the answer is, you lose. You aren't the first person to desperately want a domain that someone else owns, you won't be the last one to have a tantrum and accuse them of 'cybersquatting' for beating you to the punch. No need to pay a lawyer. This is a clearly settled issue. You can file a UDRP ($1500) and try to take it away, but you have to prove bad faith of the registrant. Remember when mom said life isn't fair? Welcome.

Are you Donald S Monopoli? If not you are out of luck. Here is the Trademark. If you are you may have a shot at getting the domain, though the mark was just filed in early December.
trademark serial: 85491141 (uspto.gov)
Though, Donald S Monopoli could in turn get in trouble with TerraBrite (two 'r') as they have had a trademark since 2009.

The names are too similar.

Nobody likes a "squatter", which is a person that infringes on a TRADEMARKED domain (Coke, Apple, etc). If you have a Trademark then you certainly have a case and I would suggest taking action. If however you suddenly want a domain that someone else owns then you have to pay for it just like people pay for land, homes, etc. It's digital real estate. There has been a whole industry around domain names for a long time. You can always file a UDRP or WIPO to have a impartial jury decide on the case.

@xin0710 We removed the comment because of other reasons however the information we provided regarding the ICANN domain resolution dispute policy is in effect. It was put in effect in 2009 if that is what you were referring to? Just as many laws are signed in to law many years ago and are still valid today. Same concept here. Please refer to the ICANN website to review the UDRP so you can understand what we are referencing. Thank you

@JasmineKara1 We're not going to pay 5,000 for a lawyer when they bought this website for what, 15 bucks a year? Definitely not! That would mean that they win at making us spend a bunch of money for a website that they have no reason to own in the first place, other than to steal money from people that are just trying to make a name for themselves.
