This series of videos begins with a rally outside then-EPA Administrator Carol Browner's office in Freedom Square, on May 16, 2000, the day after a jury found the EPA guilty of race, sex, and color discrimination and of creating a hostile work environment in Coleman-Adebayo v. Browner, brought under Title VII of the 1964 Civil Rights Act. Among the featured speakers are: Dr. Marsha Coleman-Adebayo, the senior policy analyst who prevailed against the Agency; EPA employee Anita Nickens, who describes the treatment she received under a previous administration; LeRoy Warren, President of the Federal Sector Task Force, of the NAACP, and Ron Harris, Chief Union Steward for the American Federation of Government, Employees based in Chicago. There is also CBS's coverage of the finding, and footage of a subsequent House Science Committee hearing that called Administrator Browner on the carpet. The complaints expressed span the tenures of multiple administrators at EPA by the time this video was taped. Many of the upper level managers named in Coleman-Adebayo v. Browner were never disciplined under Administrator Browner, or her successors, but survived subsequent administrators, were promoted, and are currently in the upper echelons of EPA management today, serving under President Obama's choice to head EPA, Lisa Jackson. In corroboration of the jury's findings, the House Science Committee, in an investigation that spanned over a year into charges of discrimination and retaliation at EPA found the environment within the EPA to be a "garbage can," in the words of its then-Chairman. Another investigation conducted by the Occupational Safety & Hazards Administration (OSHA) found EPA practices retaliatory. Carol Browner is now special Advisor to President Barack Obama for Energy and Environment. Dr. Coleman-Adebayo was recently fired from the EPA, illegally, in what appears to be further retaliation from managers who continued to be protected by Browner and all of her successors, including Lisa Jackson. Despite the fact that Coleman-Adebayo v. Browner and the other findings led to the passage of the Notification of Federal Employees Anti-discrimination (NoFEAR) Act, in 2001, that was designed to protect government whistleblowers, a recent Governmental Accounting Office study showed the legislation to be ineffective in curtailing, or ending retaliatory and discriminatory practices within the Federal government, and that stricter law is needed to prevent corrupt managers from continuing those illegal practices that have been shown to be systemic, particularly at EPA. Thus, NoFEAR II legislation was introduced in the last session of Congress, to provide stronger restrains and sanctions against managers found to be in violation of prohibited personnel practices.
