I definitely agree that the U.S. has become quite a reactionary society, we see this to be especially the case with homeland security and the patriot act (but not it's extension unless i'm mistaken, which I thought was a bit odd).
Those tangents aside, you bring up a good point about the ambiguity/uncertainty regarding the proverbial "lower outcomes".
