G20 Nicola Fischer police officer Delroy Smellie cleared of assault‎

Sgt Delroy Smellie denied common assault on Nicola Fisher, 36, of Brighton, during the protest in Exchange Square, London, in April 2009.

The officer told City of Westminster Magistrates' Court he feared objects in her hand were weapons.

The Independent Police Complaints Commission said Sgt Smellie could still face police disciplinary action.

District Judge Daphne Wickham found no evidence had been provided to show use of the baton was not measured or correct.

She said: "It was for the prosecution to prove this defendant was not acting in lawful self-defence.

"The prosecution has failed in this respect and the defendant has raised the issue of lawful self-defence and as such is entitled to be acquitted."


A woman who was filmed being struck by a police sergeant at the G20 protests has described his actions as "very violent and unnecessary".

Film footage showed an officer hitting Nicola Fisher, 35, from Brighton, across the face with his hand and on her leg with a baton.

"He just said 'get back', pushed me and then hit me across the face," she said.

Ms Fisher admits pushing the officer. The Independent Police Complaints Commission (IPCC) is investigating.

The sergeant accused of striking Ms Fisher works for the Territorial Support Group and has been suspended from duty pending the IPCC inquiry.

Ms Fisher, who is being represented by PR agent Max Clifford, was making her way to a vigil for 47-year-old Ian Tomlinson who died during the 1 April G20 protests.

@Tzimnewman3 What i'm talking about is, you see all these videos on Youtube of people giving the police a hard time and then making totally false claims of 'misconduct' when the officer puts a foot out of place. I'm not saying that people have to suck up and tell the police everything, I just think that people should be able to do it without acting like a complete dick in the process.

@Tzimnewman3 Tell me about it. Over 4 years I have made 10 inter-connected complaints against police officers. Non upheld, despite concrete evidence and witnesses. I was the claimant in a court case where the Judge was an hour late; (contempt of court? I should say so). He clained via the OJC that it took him an hour to find the fucking court room. AND THIS WAS ACCEPTED! by the OJC. Fucking bent or what? Freemasons???

@02Blackbeard Something doesn't smell right. Smellie is simply a thug in police uniform and uses it for protection against justice which seems to be missing in the British justice system. What court could throw out this case after seeing this video? A corrupt court and a corrupt judge?

There is only a few rare instances where hitting would be supported such as the situation being that she has a weapon and is attacking people. The video is clear. This woman is doing nothing but speaking with the officer and the only one using force is officer Smellie.
