  • @vidhead85 Yes, and what counts ultimately is the Supreme Court's ruling. So, I'll just wait, especially, what swing voter Kennedy thinks since it's all up to him.

  • @unknownunknowns I'm aware of that. Marriage has always been a state issue, but it can't impose something in regard to marriage law without rational basis. I don't know how the Supreme Court would rule in regard to Prop 8, I think that the state court may end up deciding against the proponents of prop 8 on the standing issue

  • @vidhead85 Yes but we need to remind ourselves that this ruling "does not involve whether the government must give FORMAL recognition to any relationship that homosexual persons seek to enter", according to Kennedy. So, while he believes people can be gay or not, it does not automatically mean it leads to marriage. Thus, he can go one way or another with legalizing gay marriage. Considering he brought up this notice, there might be a slight chance of ruling against gay marriage and for Prop 8.

  • Great majority opinion and it had now said: We can't criminalize sexual behavior in regard to same sex couples because we don't like them. So glad The Court protected the freedoms and rights of so many gay Americans!
