Do you think that filing bankruptcy is a stain that stays with you forever? You know, there are so many bankruptcy myths and misconceptions spread by those who really do not know the truth.

What I want to do, is to dispel a few of these myths with facts that I have gained as a bankruptcy lawyer for the past 25 years.

Here is myth number 1, "Won't bankruptcy ruin my credit?" Most people who are filing for bankruptcy already have bad credit. While it is true the bankruptcy may last on your credit report for 10 years, if you pay your bills on time after filing bankruptcy, your credit report score can often meet and exceed what it was when you filed within two years. You can also apply for credit the day after you file. Bankruptcy can actually help clean up your credit history.

The second myth people often have is, "I owe taxes, and they can't be included if I file bankruptcy, can they?" In fact, some taxes are dischargeable. If you have filed your returns on time, and owe income taxes more than 3 years old, they can be discharged in bankruptcy.

Here is another one, "Won't I will lose my home and car if I file?" In fact, it is a rare occurrence for anyone to lose any personal property such as household goods from a bankruptcy. Generally, if you want to retain your home and vehicles you can, as long as you continue to pay those creditors.
