Because he went to court with it and Timbaland admitted to stealing the sample because it's "just from some videogame", so he doesn't have to follow the legal order. Timbaland responded to the court order by calling him a "jerk", 'freakin idiot", and "I'm 15 years deep. That's how you attack a king? You attack moi? Come on, man. You got to come correct. You the laughing stock."

It doesn't matter what genre of music it is....sampling without giving credit is stealing. Hip hop songs may use samples but at least those producers who have some respect give credit to the original artist/producer.
