If phone companies go to court then the manner that the program is operated is open to public record and essentially gutted for effectivness. You mention the 6th Admendment at 23 minutes. From the Constitution "In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district where in the crime shall have been committed..." The rights of the accused are addressed and nothing is said about the right to sue.
