  • True, in general there is no duty to protect another from harm, unless there is an exception that applies. In the video example, the police officer witnessed the crime, but did not act. In this case, the officer breached his duty of care as he was a member of that class of people who are required to respond.

  • no no no, generally you do not have a duty to anyone. There is no common-law duty to take active steps to avoid or minimize the risks of harm to another, so there is no liability for an actors failure to take affirmative steps to avoid or minimize those risks UNLESS an exception applies.
