I have photoshop 9 and cannot find the path tool and I am not computer savvy at all can you help pls? Do I have a path tool?

use the move tool to select the text, the move tool also allows you to scale object up and down (if you are using CS5 make sure the "show transform controls" box is checked (top toolbar). So then you can just scale it down until it fits in the circle.
