@LookBetter4Ever Hey dummy the 4th amendment has about 10 floors of case law that go with it. Do you even know what that means? US Supreme Court ruled this was totally legal...making it constitutional.

@whiskeysauer Probable cause is needed to arrest....reasonable suspicion is needed to detain an single person. Traffic safety checkpoint (as long as everyone is stopped) requires nothing so long as the detention is brief and is for traffic safety only.
There is no search here, just a quick check for traffic enforcement of every car. If you dont like the US supreme court then tell us of a better system?

This is not Cold War East Germany. You do not need to carry ID in the USA. You do not need to show ID unless you are suspected of a driving violating or being given a citation. A warrentless stop constitutes neither. Fukk this good cop propaganda. Take back America before it gets too much worse.

they call it a dui check point but its targeted at drivers with no license so they cant tow their car for 30 days @ $200 a day so the police and city make a lot of money its a racket!!! car seizures in california is illegal and the cops know that!

I do not excuse or condone DUI. I rarely drink - and never when I am going to drive. But, I value my freedoms more than some false sense of security that is implied with these checkpoints. I say, "get in your damn cruisers, and go do your job". This is lazy police work. No two ways about it.
Would you be OK with random personal searches of our bodies on the street. Hey, it would make us all safer because we could find people with warrants, weapons, etc. Why not that? You know why..

I've read the ruling. I disagree with the majority ruling. Remember, these are just humans on the bench. They are not Gods. They are not all-knowing. People in Nazi Germany did what they did under the "legality" of a regime. It did not make it right or just.
This DOES violate the tenants of the 4th and 5th amendments. There is ZERO probable cause when they stop the vehicles. The court opinions even acknowledge this. But, they excuse it with some "balance" BS to twist the constitution.

Michigan Dept. of State Police v. Sitz, 496 U.S. 444 (1990). checkpoints are constitutional.
DUI Checkpoints = Random Search = Un-Constitutional! 4th Amendment!

I wouldn't call it ignorant so much as cautious. It seems you are content just standing by and letting your rights erode away. In this instance, one is effectively guilty until proven innocent- quite the contrary to the constitution's intent. I would rather allow a "drunk ranchero" to drive slightly intoxicated than be interrogated and have my privacy invaded by a jackass (cop) with a high school education. As for the last part of your comment, I speak no Spanish, so it means nothing to me.
