Man Convicted After Dash-Cam Captures Shootout with Police

KANSAS CITY, MO - A metro man was convicted to 30 years in prison after prosecutors said that he tried to execute an Independence Police officer in an incident captured on police dash-cam.

Nicholas Waller had committed two carjackings on the night of April 4th, 2009, when he was chased on foot by Independence Police Sgt. Steven Boles. Waller had shot at Boles five times, missing each time, when Boles managed to fire back three times, hitting Waller in the chest.

Waller was then knocked down by a police cruiser driven by Sgt. Barry Huwar, whose dash-cam captured the entire incident.

"I thought my life was over when I started taking the gunshots and I couldn't get my gun out," said Boles. "I feel God put me on my knees that day and allowed me to persevere."

Waller had just carjacked two different drivers including a pizza delivery driver at an Independence 7-11. He abandoned the car in front of a nearby home and took off on foot only to be stopped a minute later by Sgt. Boles, shooting at him before Boles could get a word out.

On Thursday, Nicholas Waller apologized in court, blaming his problems on years of drug and alcohol abuse, saying he started sniffing glue at age 12. He had already served years in prison for six prior felonies including assault on a law enforcement officer.

"Everyday I put the uniform on I realize it could happen again," said Boles.

Jackson County prosecutor Jim Kanatzar called Waller's attack on Boles an attack on all police everywhere.

"It's a violence against all police officers who stand up everyday and try to protect society," said Kanatzar. "We felt that a life sentence was appropriate in this case, we felt consecutive life sentences was appropriate in this case."

Waller will be eligible for parole in 25 1/2 years.

  • I see a lot of hatred from people about this video, hopefully the guy lived and can somehow learn to be a different person through rehabilitation. I also hope that none of the officers were injured, or harmed. That cop made some good use of his patrol car in subduing the suspect as well XD.

  • I'm sure I'll get a lot of intelligent comments for this, but I went to school with this guy. This was not shot in some poor ghetto neighborhood, but in a well-to-do district in the mid west. Nick Waller is actually a very intelligent person. He made excellent grades in school, came from an affluent family and is a genuine prodigy when it comes to piano and guitar. I'm not saying what he did was justified whatsoever, but you have to realize that drugs can get their grip on the best of us.

  • Sounds as that he was still under the car!! see if he can shoot stright now. He deserved anything that happened to him. Shoot at us, get killed or anything else that happens, it is the criminals own fault..

  • They should have parked that patrol car on the bastards head. That would have saved tax payers money.

  • What you don't see is the officer in the car when he first stopped he drew his gun and was shooting at the suspect, through his windshield. After he realizes that the bullets are not hitting the suspect he then uses his vehicle to stop the threat.

  • When someone is caught on video being 100% guilty of a crime like this the punishment should be splashing with boiling oil and forced to undergo extemely painful skin graph treatment with NO sedation.
