If you are saying that secession is illegal now then you would be right in most cases. There are a few states that still have the right to secede whenever they see fit according to their constitution. However if you were saying that secession was illegal before the war then you would be incorrect on all counts. Texas vs. White was a case that was tried 4 years after the civil war had ended. Before this case secession was a states rights issue as it was not directly stated in the constitution.

It and the 13th amendment were passed when a substantial portion of white Americans could not own property or even vote, and when their legislatures were occupied by Reconstruction officials that did not represent the states in question. (This is evidenced by the fact that they were turned out of office as soon as Reconstruction ended and there were no longer bayonets forcing Southern voters into compliance.)
