@gstanz67 Because, according to the Supreme Court, detaining a driver without suspicion of any crime or violation and requiring a license / registration / insurance is unreasonable under the 4th amendment - and therefore illegal.
Legally speaking, nobody is required to show a license at a DUI checkpoint unless they are under suspicion of an actual DUI or other traffic offense.
And before you ask, yes I do have a license, and yes I've said this to a cop - and was done and gone.
-
@IowaFirearms Seriously? did you just ask that ?I take it you have never had a drivers license.
-
OMG that was exactly like Nazi Germany. You were stopped for a whole 10 seconds....the whole video is just over a minute. JESUS CHRIST save us from this tyranny.Im gonna have nightmares now after watching this video. Thank you for posting this. This is a perfect example of the extent of a DUI checkpoint for those that are legal to drive. 10 seconds max. Wow that must have been horrible to experience. Did you feel violated afterwards? Are you still showering 5 times a day after that rape you got?

@CaptainCocaine "the cop will tread a bit more lightly with you, knowing that he could end up on the wrong side of the courtroom if he tries the usual tricks that work on the general populace "
More likely it has the opposite effect- cops interepate that as being a smartass or being disppectful ( or non complianant) and act accordingly

@badpanda84 I'm not saying to refuse any of their orders. However, if you show that you are aware of your rights--with real knowledge, not just saying "I know my rights"; that never works--the cop will tread a bit more lightly with you, knowing that he could end up on the wrong side of the courtroom if he tries the usual tricks that work on the general populace who'd rather just get the traffic stop over with.
Most drunk drivers either don't know their rights or are too dumb to articulate them.
-
@CaptainCocaine Arguing with the cops never works -- because they expect it -- every drunk idiot is going to claim "I'm not drunk you have no reason to stop me"
If the cops backed down every time someone argued with them they would never arrest drunk drivers
-
Why did you even give them your license????

its time to move on.. after watching this video, i just forget myself!! i thought ...i am driving...nice video..
"Except where there is at least articulable and reasonable suspicion that a motorist is unlicensed or that an automobile is not registered, or that either the vehicle or an occupant is otherwise subject to seizure for violation of law, stopping an automobile and detaining the driver in order to check his driver's license and the registration of the automobile are unreasonable under the Fourth Amendment" SCOTUS - Delaware v Prouse
In case you wanted to argue it next time.

@CaptainCocaine As much as I would have liked to, I would have just been taken to jail and had to waste my time fighting it with lawyers and what not. The police are never going to be like "Ok, you know your constitutional rights, you are free to go." Never gonna happen unfortunately.
