I have always thought that Smallville will end with a HUGE reset button. Where Jor-El will wipe everyone's memories of Clark (with the exception of his mother and Clark himself).

That way the final scene can be Clark going to work at the Daily Planet five years with his glasses persona ready to go, but him still remembering that he loves Lois. However, she doesn't know him. I'm sure the final line would be her calling him "Smallville"...and it sounding right to her.

i gotta a feeling that its the later, given the whole Lois story arch where she travels through time. i have a feeling her going into the future at the end of last season will cancel out Lois and Clark's relationship during this season (when they get to the end of season 9) and everything will be undone or some hocus pocus like that. that's Smallville for you, it doesn't have to make sense

Okay, it looks like the agreement is gone due to the spoilers about them kissing twice at least this season.

OR

The whole season will be reset at end of the season and those kisses will be wiped out and would be fine under the "can't get together without being reset or under the influence" agreement.

The WB don't exist no more...so i don't see any reason why they don''t just let them fuck and get it over with. and don't give me that whole clark can't have sex with humans thing. that was probably the stupidest thing Gough and Miller introduced to the show...and that's saying a lot. the show has gotten much more interesting since those two left.
