@bazfanv2 Duh because he doesn't know how to handle attorney calls! So the call should have went to a supervisor to begin with.
-
@Nauticalman The supervisors should be taking the attorney calls, PERIOD!
-
@kianneis13 WRONG! The worker talked to the consumer's attorney (NOT the consumer), it is not illegal if they intend to proceed with suing if they are allowed to do it and intend to do so. If they are just making statements of something that they don't intend to do, then that's when they can get in trouble.
-
@starlightperkins330 It's not a threat to say they´ll send it to their legal team if the collection company intends to take such action and is capable of doing so. The worker is not talking to the consumer, but rather the attorney.

Continued: Filing a police report on someone because they say they will take you to court makes no sense. If I owe you money, and I don't pay, and you provide me proof of how it's owed, then yes you can take me to court. How does it make sense to file a report? This is one bad attorney! Also the worker on the phone could have been nicer and should have their supervisor handle attorney calls in the future if they don't feel comfortable doing so.

I know lots about debt collection (FDCPA, and FCRA). The thing is if they provide validation of debt, and they send it to their legal team to review the case they are allowed to do that. According to him, his collection agency does it all the time. Remember FDCPA says they cannot state something that they DO NOT intend to do or cannot do. If they can send the consumer's account then they are allowed to. The worker is talking to an attorney so their is no threatening to the consumer.

It is extortion if you threaten people into paying them. It's pay me or else.
He feels uncomfortable becos he lost control of the call - now suddenly the debt collector is getting some of the shit back he deals out 8-12 hours a day. Debt collectors are wankers.

Wow, that's the first time I've ever heard a debt collector say "I don't feel comfortable" right after he makes a bunch of legal threat. hahaha
