They're sworn to uphold the law, but one Weirton police officer has decided that he is above the law. His supervisors agree.

Officer Gregory Moodie was involved in a traffic crash on US-22 in Weirton that injured an innocent husband and wife. When police got on the scene they smelled a STRONG odor of alcohol on Moodie's breath, and administered field sobriety tests. They found Moodie had an alcohol level of .144, nearly twice the legal limit to drive.

The officer was placed under arrest, and the case was turned over to Weirton police for investigation. Weirton Police Chief turned the case over to the West Virginia State Police becuase he didn't want the department to be accused of favoritism. The state police did investigate and charged Moodie with drunken driving.

"We definatley are held to a standard by the public, and rightfully so, said Sgt. David Robinson of the West Virginia State Police. "We are the ones who enforce the laws, and definitely should obey the laws we enforce."

The DUI is a misdemeanor charge. Moodie faced up to a year in jail and fines but he pleaded no contest Monday to a DUI charge andOhio County Magistrate Patricia Murphy gave Moodie the "Professional Courtesy Treatment of An Officer" and sentenced Moodie to 500 dollars in court costs and fines, and his license has been suspended for a whole 6 months.

Some Weirton residents said police officers deserve a stricter penalty.

They should have a higher standard, said resident Carl Seamon. They're supposed to be people you look up to."

Others said Moodie should be treated just like everyone else.

I feel what he got is fair, said resident Zita Stickles. Hes a good person, he does a lot of good things for us in the community, and I think he'll do a lot more."

Since Brooke County prosecutors often work with Weirton police, they called in a special prosecutor from Marshall County to avoid any conflict of interest.

City officials said Moodie will be facing disciplinary action because of the case, but witnesses have said that they have already seen Moodie back on the streets working.

Must be nice to have "above the law" privileges, huh?

  • thats messed up, a dui in ontario canada is minimum 1 year and 500$ fine and back on track program and it cossts 600$ and is a 11 month program.... he got off with a slap on te rist lol tisk tist police dept.
