ITSCO notebook Laptop Falsche Garantie! PASSAUF IBM thinkpad T30 Crash Review Lenovo

Dont believe what ITSCO.DE says about warranty.. (please read the email at the bottom)

I made the complaint 6 months after buying the laptop, it appear that had 1 year warranty.

The laptop came with a very used battery who gave only 20 min work time...

I spoke personally with the ITSCO and IBM people, they told me that they will not cover me and they recommend me to bring a lawyer, that means "customer satisfaction".


All the diagnostics go fine but suddenly the computer crash.



CPU temp: 54°C

UPDATE: At the end the motherboard had the PCB lines burnt. How? I don´t know but it seems it was caused by a too much used motherboard.

Watch out with this model because have problems with the RAM slot, disabling the 2nd one. Yt the end you can only have 512 MB RAM.

vielen Dank zunächst für Ihr Rückmail.
Innerhalb des ersten halben Jahres der einjährigen Gewärhleistungsfrist, hat der Lieferant bei einer
Reklamation nachzuweisen, dass das Gerät bei der Lieferung in einem einwandfreiem Zustand war und die
Reklamation daher unbegründet ist. Dies ist jedoch i.d.R. dem Lieferanten nicht möglich, da bei einer
Reklamation innerhalb des ersten halben Jahres davon ausgegangen wird, dass der Defekt bereits
bei der Lieferung vorhanden war.

In der zweiten Jahreshälfte des Gewährleistungszeitraumes hat der Kunde nachzuweisen, dass bereits
bei der Lieferung ein Defekt bestand, der zum späteren Ausfall der Komponente oder des Gerätes führte.
Dies kann der Kunde i.d.R dann, wenn er z.B. bei der Lieferung des Gerätes die Lautstärke der Festplatte
bemängelt, das Gerät aber dennoch erst einmal weiter nutzen will. Fällt in der zweiten Jahreshälfte des
Gewährleistungszeitraumes die Festplatte aus, ist der Lieferant zum Ersatz verpflichtet.

Dies ist im Groben die Aussage der Beweislastumkehr

Sie reklamierten allerdings erst außerhalb der Übernahmegarantie.
Eine Gewährleistung ist in Ihrem Fall auszuschließen.
Gem. unserer AGBs hat der Kunde in Übereinstimmung mit den geltenden Gesetzen eine Gewährleistungsfrist von einem Jahr.

Die Beweislast liegt in den ersten sechs Monaten bei dem Verkäufer, in den zweiten sechs Monaten bei dem Käufer.

Umkehrung der Beweislast § 476 BGB:
Zeigt sich innerhalb von sechs Monaten seit Gefahrübergang ein Sachmangel, so wird vermutet, dass die Sache bereits bei Gefahrübergang mangelhaft war, es sei denn, diese Vermutung ist mit der Art der Sache oder des Mangels unvereinbar.

Eine Gewährleistung ist in Ihrem Fall auszuschließen, da der Gefahrübergang der Ware mehr als sechs Monate beträgt.

Wir bedauern Ihnen keinen anderen Bescheid zukommen lassen zu können, hoffen allerdings auf Ihr Verständnis.

I have tell you what happened. At the end the notebook is in the garbage can. The motherboard began to fail slowly, beginning with this symtom. But after failed completely. TEchnical Service said it is burned, the path on the motherboard PCB were burned without repair.

Hm, I have ran FMV's, duke nukem 3D with high resolution pack and still no overheat, running windows XP sp2 on 1,8ghz and 512mt ram, 2633 model(I think)
