Irish282, Updownmostly, YTV, the DMCA and Censorship

Irish282 advises people to use the DMCA as a tool to get videos that they consider death threats or slander removed..

This is a bad strategy and it is an abuse of copyright law to censor videos that contain information and allegations that you would rather not have others see. If you are legitimate and have nothing to hide then a far better strategy would be to stand your ground and tell the truth. Use evidence and logic to dispute the evidence that your "haters" bring to the table.

I give an example of how this can be done. In the following video, Amigacam alleges that Updownmostly's subscriptions, along with other evidence, provides sufficient reason to believe Updownmostly is a pedophile.

Yet, when put in perspective, Updownmostly's subscriptions to children's channels might not be that sinister. Updownmostly subscribes to nearly 900 people and is not at all discriminating in who he subscribes to. Updownmostly made a video describing the philosophy driving his subscriptions in this video.

Subscribing to say 30 or 40 children is a huge red flag if you have only 60 subscriptions. It is not as large a red flag if you have 900 subscriptions. Perhaps Updownmostly subscribes to a disproportionate number of children, but that isn't the impression I got when taking a VERY QUICK look at his subscriptions. Someone with more time than I have might want to look through his subscriptions more closely and determine just how many children he subscribes to. Then we can see what percentage of his subscriptions are to children's channels and use this as evidence in deciding whether or not he is likely to be a pedophile.

The point is, if you are truly innocent then you are better off presenting evidence in your favor, rather than using the DMCA to censor videos questioning your character. When you use the DMCA to suppress your opponent's videos then you are admitting you can not win without censorship. This is a big red flag.

5UB5373N's made a video on Irish282 and Updownmostly that is vulnerable to a DMCA takedown notice because it uses video clips of others to make his point.

5UB5373N's use a video clips falls within Fair Use, but that will not protect it if someone files a DMCA complaint against it in order to get the evidence it presents flushed down an Orwellian Memory Hole.
