  • The charge can be changed (not plea bargained) if the State does not believe it has the evidence to prove its case beyond a reasonable doubt. This results, usually, from a problem with the breathalyzer that would make its reading inadmissible into evidence.

  • if they cannot plea bargain, how can they change the charge to something less serious? wouldn't this be a form of plea bargaining?
