David Challice reminds us that there is a written British Constitution. He refers to the hisorical documents that contain it, including Magna Carta, the Bill of Rights, the Acts of Union and the Coronation Oath. In this age of eroded individual freedoms it is food for thought.

  • but we have a uniqe constitution, where there is multiple documents and parliment can change anything they want

  • It gives us more rights and freedoms against the monarch even though we are "subjects" of the Crown. IT enhances an individuals freedom and rights and liberty and to have more choice and not be subdued by suppression or oppression.

  • @11malcolmdavid11 even so, any government can withdraw from the eu relatively easily. if they make a law that goes against the HRA, they can issue it with a 'declaration of incompatibility' to get around that. Then it's for the judiciary to decide

  • @paiselbee198 Human Rights is an EU Statute. Parliament has no jurisdiction over EU. So no, it couldn't repeal it unless it removed itself from the Lisbon treaty. Parliament is governed by the Rule of Law, like the rest of us. Nothing is just Law. It is made under representation - we the people. Any member of office is bound by his/her oath, which is an Oath to the Queen's Majesty - pertaining to the contract she promised to honour in her coronation oath.

  • @chrisroach254 The Americans used our Declaration of rights (Bill of rights) to form their own constitution, lifting some of it directly word for word. Check out the bit about cruel and unusual punishments. Also redress and remedy. In response: British Constitution was the first of its kind. You can find the Bill in the statute database on the governments website.

  • @GarySherborne Definition of constitution: A constitution is a set of fundamental principles or established precedents according to which a state or other organization is governed --- Read the Magna carta, Bill of rights, to begin with. These are the foundations of our constitution. Read them carefully and you can see that they are a contract between us and the monarchy that can never be broken without the say of the people and Monarch in accordance with each other.
