That's not necessarily true. If the crime or fraud is the very thing you are suing or prosecuting for, any confidential communication with the attorney is covered by the privilege. If it is a criminal or fraudulent act related to the proceeding, i.e. you are lying to the Court to save your ass, then in that case, yes you would be correct.
That's a terrible question. How could the deponent know whether his competitor checked an earthquake chart? For all he knew, the competitor just made it all up in their reports.
