A cop isn't allowed to pull over drivers without probable cause that they're under the influence or committed another crime. But there's one big exception to this rule . . . Nevada DUI Sobriety Checkpoints

Las Vegas Metro police and the Nevada Highway Patrol (NHP) routinely set up drunk driving checkpoints over holiday weekends and during special events in high-traffic areas. At these sobriety checkpoints, police are allowed to stop and arrest you for driving under the influence even if you were driving safely and wouldn't have been pulled over otherwise.

But if you're charged with driving under the influence as a result of a Nevada DUI checkpoint stop, our Las Vegas criminal defense attorneys may be able to get your whole case thrown out if we can show that the sobriety checkpoint didn't adhere to the correct procedures.

  • One more question: Since the Supreme Court ruled in Michigan v. Sitz that when stopped at the Checkpoint, you are "siezed as a person," and in Miranda v. Arizona they ruled "once siezed, if questioned the suspect must be read his Miranda warning, By law are the Police required to :"mirandize" the individual prior to asking questions?

  • Are you Joking? Telling people to incriminate themselves by doing FST's and answering questions.?

    Also if METRO is looking for people thata are being evasive, it is METRO who is breaking the law and Must be punished.

    My question is: What if the Checkpoint is NOT set up in accordance to Nevada law, Does that constitute illegal siezure? .
