assault with a deadly weapon no because a skateboard couldn't kill someone unless you mashed their face in or robbed someone, misdemeanor assault maybe depending on the CA Penal Code, or Disorderly conduct would be the appropriate charge. However if they didn't tell you not to skate in the store you could have it dismissed on a Negligence claim as a defense to the prosecution. Yes that charge is BS and a bit overreaching for what happened based on this little piece of evidence.
