This bug has been finally fixed with Unofficial Oblivion Patch Supplemental 3.3.6, on TesNexus. Enjoy lichs that will attack you with magic spells even when disarmed!

You can keep the staff too, I've have several staffs that I took from my own Lichs. It will take about 600 total points of disintegration to break the staff and the Lich can reflect your spells, so, it's best to do the glitch while unarmed.
