They got away with a bunch of stuff back then -- some of the music was based on works of The Beatles (the New Age Retro Hippie's theme, though, was based on Chuck Berry's "Johnny B. Goode"), an enemy was modeled after Salvador Dali's "Persistence of Memory" (a.k.a. "Dali's Melting Clocks"), the Tonzura Brothers were a parody of Saturday Night Live's Blues Brothers, one truck's side decals parodied the Coca-Cola logo... and I dunno what else.
Nintendo would get sued these days.
