In September of 2007, I sponsored the first bill introduced in Congress to allow judicial modification of mortgage loans for primary residences in bankruptcy. The bill, H.R. 3609, the Emergency HOME Protection Act, was approved by the House Judiciary Committee in December 2007, but did not come to the floor. In the first week of the new Congress, I introduced a new version of the bill H.R. 225, the Emergency Homeownership and Equity Protection Act. The current bill differs from H.R. 3609 in that, unlike its predecessor, it would apply only to existing home mortgage loans. I appeared as a witness in front of the Judiciary Committee today to speak on the failure of current voluntary mortgage modification programs.
