The letter I sent:

You have recently banned a very popular user named NickGisburne (previously Gisburne2000). I strongly disagree with your decision. I find this to be an extremely chilling action on the part of YouTube.

Apparently, you found something offensive in his last video. I have reviewed the contents of this supposedly offensive video myself. It consists entirely of quotes from an english translation of the Qu'ran. I cannot otherwise conclude, therefore that this is a ban based on religious grounds. I find that to be extremely disturbing, as this kind of a policy will affect many thousands of YouTubers.

From everything I know of him, and his side of the story, this is almost certainly an unjustified banning. The body of the work in his videos are not in anyway obscene and represent the views of a lot of us here on YouTube. In the past I have observed that individual videos have been banned, however, I cannot for the life of me understand why you would take away his entire account which contains so many other videos of valuable content. Some kind of "repeat offender" status on Nick also seems ridiculous as his infractions have never risen above the most minor (a copyright that was resolved?).

I do not find your actions consistent with an entity interested in fostering trust in our community here. It pains me greatly that you could take this action which so clearly causes harm to it, and especially to someone as harmless and yet as valuable to the community as Nick clearly is. Your actions are also just clearly wrong on the face of it.

I would respectly request that you simply restore his account, with a full explanation for why you banned his last video (with the ban on his last video, alone, at your discretion). The email you sent to Nick was clearly insufficient. Remember that we who make up the community, have other options at our disposal which include bringing attention of this action by YouTube to the media (something you must *KNOW* we have been searching for an excuse to do) and encouraging defections to other social video sites.

  • Well i have a begining of answer to that. Of course the translation problem goes straight to the opposition of two schools of thinking within Linguistics (among others): Relativism and Positivism. You will never find an accurate enough translation of the Qu'ran because Language is contextualy embedded within culture..anyway. We ought to be careful when taking quotes from the Holy texts. But youtube and google are wrong. thx 4 posting. Bring him back NOW.

  • They did say that the song he used in the Holy Quran video was copyrighted. YouTube initially banned Nick for inappropriate content, not copyright issues. I strongly suspect that if he used no sound track at all, that matters would have ended there, i.e. Nick would have been banned. YouTube belatedly recognized the firestorm that their decision would engender and "wisely" adjusted their position to more effectively deflect criticism.

    The censorship of Nick Gisburne is morally reprehensible. This type of behavior has the potential to alienate many members, transforming the current image that YouTube enjoys into something far more sinister. I believe it is in your best interest to reevaluate this decision.
