You're right, except that rule can be bypassed with engineered foundations for the crane. In this case, they made an effort but failed to account for heavy rains and the consistency of the riverbank.
As for swinging, I don't think the operator had anything to do with it. As soon as the crane sank at the back, the weight of the counterweight would easily overwhelm the swing motor and "fall" to the rear.
If he was smart, he would have lowered the load immediately.
