  • Might want to THINK twice about suing. I had to do that once in New Jersey and HOA harassed, ostracized even my young children that were only 4 years old at the time. VERY ugly, immature, unprofessional and unethical in my opinion. Once you sue you're stuck living with the anger, vindictiveness, etc. They will always thing they are right - even after they loose the lawsuit~!

  • More HOA Board Abuse! Which is why I am trying to get our own board under control with a $3 million lawsuit against the HOA and individual board members (details on my YouTube.) This abuse has got to stop for all 22% of the population who are currently serfs in these HOA fiefdoms!

    I am interested in watching your Youtube video. How can I find it? I have been under attack from the board members, the manager and their friends since I purchased my house in 2003.

  • These people on the boards do become selective when it comes to enforcing the covenants. All states need owners protection against the HOA's like the Davis Sterling Act of Calif..

    Do something now, move this to law in your state. Don't live in a dictatorship, which is what these people turn neighborhoods into.

  • I suffered HOA hell once and since I am good with finding loopholes I fought back and won. Basically I exploited loopholes that would have made the neighborhood nazis cringe each day as they drive by.

    Now I live in a neighborhood with what I call "common sense covenants" and also where the people who buy here have enough money to care without some meddling hag coming in and making our lives miserable.

  • a couple of points: the attorney is right of course that the board typically makes the decisions. However -- if the homeowner consistently and repeatedly receives fines, warnings etc from the MANAGEMENT FIRM, it can be argued that the board has WAIVED its right to control and the FIRM can be held responsible.

    Also a good way to fight abusive boards is simply to make a utube video, as I did, which I've posted
