  • Habeas Corpus only solves half the problem. No real defense can ever be given unless you also have the right to face your accuser or to have evidence of an individual or individual victims. No victim = no crime. Until there is an individual victim or evidence leading to an individual victim you can never put up a defense. If an individual kills a group of people then that person gets judged on each individual count of murder. Why should the case be different in any other situation?

  • @HereinLasVegas Lol I had a feeling you thought that I meant amendment, not to worry you were still right. It is only because I have been researching your constitution for my website that I know any of the details. I'm afraid I am from the country slagged in the declaration-England. Nice talking to you I'm glad we both learnt something :) I fear both our countries really don't respect their constituions and see them as merely something to work around. But at least yours is beautifully written :)

  • @fixdreamer LOL...maybe I'm an idiot after all. When you wrote Article 5, I assumed you really meant the 5th Amendment. I thought that because you were not American you used the wrong terminology. Anyway, Article 5 deals with Amendments and does contain the words you quoted. I'm appreciative of the conversation as it gave me the opportunity to learn something. Now if we could only get our Government to live within the contraints of the Constitution.

The 5th Amendment does indeed exist, it just doesn't contain this part as your stated "shall be valid to all Intents and Purposes, as Part of this Constitution". To tell you the truth, I don't even think thowe words are in the Constitution at all. What Country are you from?

  • @HereinLasVegas Sorry for calling you an idiot I am an idiot for doing so, I was very wrong and very rude. I absolutely agree with your point. The declaration states "they are endowed by their Creator with certain inalienable rights" and that is the basis as you say. I was a bit drunk last night and feeling arrogant, I shall curb that next time. Sorry @HereinLasVegas. If you don't mind me asking what did you mean by the 5th article of your constitution not existing? It is there.

  • @fixdreamer Obviously, you are not from the US nor do you have any undersstanding of its foundation. The premise of our Country is that God gave us inalienablerights as humans, OUR Government is established wit the provision to protect those rights with the consent of the Governed. The 5th as you quoted does not exist.....and you call me an idiot.Our Constitution garantees rights, it does not give them...rights come from God,

  • @HereinLasVegas I'm not even from the US but I understand that the amendments to the constitution as spelt out in article 5 of the constitution "shall be valid to all Intents and Purposes, as Part of this Constitution". Given that the first 10 amendments are known as the bill of rights you are wrong and most probably an idiot. The constitution most certainly does give rights. Anyway looking specifically at your point, the privilege "shall not be suspended" is a right, obviously!! Go to school.
