I think it is ridiculous to expect someone to ask permission to perform an effect that has been made commercially available. If the effect means that much to you then you should keep it for yourself and your audiences, assuming that you have an audience.

Right!!! Frank Garcia's tricks picked Simon, not Simon picked Frank Garcia's tricks. And yes, Simon called Frank after he died and asked him permission. The hypocrisy is unreal by Simon...whatever living he has made from magic he owe's much of it to those amateurs that don't have an "act", that don't have a "trick", etc. My question is to Eric, "what in the hell are you doing talking to these morons?"
