Per 8 USC 1324a and the DHS I-9 Form:
"Anti-Discrimination Notice. It is illegal to discriminate against any individual (other than an alien not authorized to work in the U.S.) in hiring, discharging, or recruiting or referring for a fee because of that individual's national origin or citizenship status. It is illegal to discriminate against work eligible individuals."

The Immigration Reform and Control Act (1986) prohibits the employment of unauthorized aliens, BUT the law also prohibits employment discrimination on the basis of national origin or citizen status. The purpose of this provision is to discourage employers from attempting to comply with the prohibition against hiring unauthorized aliens by simply refusing to hire applicants who are foreign-looking in appearance or have foreign-sounding accents. So technically what he did was not illegal.
