It would need some sort of a trigger that you can quickly touch. Like a button on the inside of a sleeve or something, although you'd still probably unwillingly shock people in a packed crowd. Cruel but insane funny as long as it doesn't happen to you : )

What about people in the subway? Or you know crowded streets? Unless you are a huge asshole, having a shocking jacket wouldn't be good for those other people, who in turn would get pissed off at you, and then most likely proceed to beat the shit out of the only exposed place on your body. Your head.

To answer your questions though; I have studied much into criminal profiling. From my education I learned that this is a common tactic that serial rapists and serial kidnappers use to avoid harsher punishment for when they are caught. There is a difference of 15 years in a prison and life in prison on if a weapon or not was used. At least in the US this is how the law is.
