I don't think Delta 707 needed to intervene at all. Yes he'll "do what he has to do", but let's try and do it safely, eh...

Props to Delta 707 for telling ATC that Aeromexico is gona do what he has to do because its true. As a pilot you can deviate from ATC to keep the aircraft safe. Yes he might have not been cleared to 6000 but the controller can send whoever is close back out somewhere.

sometimes i think that controlers should know a bit more about airplanes, you can't ask a pilot to hold at a level where windshear is encountered.... and as much as I love the stand that the pilots in 402 took, they should've insisted in climbing higher if they needed to....
