An 8-year-old boy accused in the deaths of his father and another man gave police conflicting accounts about the shootings, at one point saying, "I wasn't shooting any guns" before admitting to firing at least two shots at each of the men. (Nov. 19)

  • @vipsta11- An 8 year old would NOT understand the seriousness of what he did. They do not have a adult's concept of permanence. You don't punish a kid like an adult since kids do not have the brain development to appreciate what they are doing. Recent brain imaging studies are demonstrating that the brain is not mature enough to comprehend violent acts until the age of 21 or 22. We are talking about the anatomy - the actual structure of the brain. Not some mushy concept like insanity.

  • @joshmccraney720: Actually, I think you mean "malum in se" (singular) not "mala in se" (plural). Just bc you throw some Latin around doesn't make what you say correct. Yes, the killing of a human being is "malum in se" but the killing can happen as a result of illness, accident, what have you. We don't trust an 8 year old to vote, drive a car, whatever. Because they are not adults. For the same reason the law should not treat an 8 yo like an adult. & - public policy issue - rehab is preferable

  • @jadegizmo You are a 17 yo and are proving my point for me. Anyone who thinks that subjecting an 8 y.o. to a beating "is not a bad thing" is extremely immature. I knew before even looking at your profile you were a kid. Kids are not adults; they should not be held responsible for having the maturity and insight of an adult. Plain and simple.

  • @cloveredrover Let me ask you something. Would you give an 8 year old unsupervised access to matches? Yes, he "knows" matches start fires but does not have the insight to understand the consequence of playing with matches means death and destruction. The state will punish a parent for leaving an 8 year old alone unattended bc 8 year olds are not adults and they lack the capacity to make rational decisions. An 8 year is incapable of forming the 'mens rea' for murder. Class dismissed.
