The fact that waterboarding is becoming a form of protest would suggest that while it is unpleasant, it would not qualify as torture. It should also be pointed out that waterboarding was not used widely. Guys like khalid sheikh mohammed should be waterboarded as a means of compelling cooperation, torture or not.
