UPDATE: The ACLU's May 10 letter supporting the students is at http://www.aclunc.org/cases/other_legal_advocacy/aclu_to_school_district_stud...

When students at Live Oak High School in Morgan Hill, California, were sent home for wearing American flag t-shirts on Cinco de Mayo, the coverage I saw on Fox News, while supportive of the free speech rights of the students, still had some problems as I show in this video.

The clips I use of Steve Doocy and Brian Kilmeade come from the Fox News program "Fox and Friends" broadcast on May 7, 2010 (which I have not been able to find online).

The clip I use of American Civil Liberties Union of Northern California staff attorney Julia Harumi Mass comes from the KGO local news program broadcast on May 6, 2010, available online at http://abclocal.go.com/kgo/story?section=news/local/south_bay&id=7427683

The image I use of my video titled "Fox News Anti-Islam T-Shirt Story Unfairly Attacks ACLU" comes from the YouTube player page at http://www.youtube.com/watch?v=iF4Ps_yAmKA

The image I use of my video titled "Supreme Court Takes Bong Hits 4 Jesus" comes from the YouTube player page at http://www.youtube.com/watch?v=dPuD7xrpurI

The image I use of the US Supreme Court case of Tinker v. Des Moines School District, 393 U.S. 503 (1969), comes from the Findlaw page at http://caselaw.lp.findlaw.com/scripts/getcase.pl?court=us&vol=393&inv...

And, finally, the images I use of the ACLU of Northern California's free speech guide titled "Know Your Rights: Free Speech, Protests, & Demonstrations in California" comes from the webpage at http://www.aclunc.org/issues/freedom_of_press_and_speech/asset_upload_file647...

I agree. It was wrong for them to be sent home. But I am willing to bet that those kids in the picture just wore those shirts on the same day as each other (Cinco de Mayo) just to cause ethnic tensions in the school even though the US does not really have anything to do with Cinco de Mayo at all.

If I remember correctly Cinco de Mayo celebrates the day when the Mexican army defeated the much larger French army.

  • (im am mexican) it was wrong 2 suspend or send them home but its understandable why they did it, look those kids would've just started a big issue with all the other mexican students. but they could told the kids 2 turn their shirts inside out or go home and change

  • I can't help but be saddened and utterly dismayed at the level of literacy of some of the people who have written comments about this video. It makes me think the issue in schools has nothing to do with USA flag t-shirts, Cinco de Mayo, or free speech. The issue is that the schools are broken. Their primary mission is to create a literate populace, which is fundamental to a democracy....

Ahhh. Never mind, NOW I see why we keep sending idiots to represent us in government.

  • burn the flag ok, wear it in usa illegal wtf

jesse ventura kids go to school in mexico the mexicans better don't wear theirs flag

  • @WestsideJuggaloFam who cares if they were wearing pro usa shirts? who care sif it started something with the mexican students? Your either mexican or you can be american! if you wave mexican flags and yell vvia mexico and viva la raza then why ar eyou not in mexico? love the country thaat gives so much to you and you take so much from! this is usa not mexico. if some mexicans got sent home for wearinf mexican flags(which they should) lmao it would be a national out rage!

  • Muslims do do something the other day i went to church ND they said that Muslims r attacking catholic church for there beliefs.

Also its America Not mexico/ im Mexican i find this wrong

when my dad was little he wanted to go to school in mexico because his parents moved over there and they no tu hijo es amricano mandalo para ya. ypur son is american send to school to the usa,

  • @AndromedaFollowsMe malarchy regaurdless of what there motives are th fact is you have no right to impose a holiday on anybody muslims cant tell christians to fast on ramadon an irishman cannot tell a polish guy to celebrate st. pattys day and a mexican american cannot send his students home for wearing american flags on the 5th of may

  • Cinco DeMayo wasn't even Mexican Independence. That was Sept 16th from spain. Cinco De Mayo is a holiday for defeating a French Militia that numbered less than 400.....

  • Kids are being sent home from school, for wearing American flag shirts to school on Cinco De Mayo. WTF???????/ American school, American soil?, Mexican holiday censuring American kids at American schools for wearing there own nations flag on a shirt during another country's holiday. What the fuck is going on with this country?

  • both political sides do it stop shouting foul at fox cause ABC, NBC ect all do the same

  • @AndromedaFollowsMe Yes the whole poinyt is why do we celebrate a foreign countries holiday? the judge ruled it wasn't a freedom of speech right for their own protection from the angry hispanics.

  • I don't see a problem with this. Those students are Americans and this is their country so they have the right to wear shirts with the American flag on it on 5 de mayo. If Mexicans were offended then the school board should make a rule that states no one can wear anything representing their country flag. This goes for Mexicans and Americans. This would solve that.
