The head of the company is responsible for making sure that the lower level employees are complying with the health and safety regulations. Clearly this didn't happen. I think that both the head AND the lower level employees should be held responsible.

I wonder if you would feel the same had your mother, father, spouse or child suffered from this trajedy that could have been avoided. Legal precedence demonstrates that YES corporations are responsible for their employees actions or inactions. I.e., Exxon Valdez Spill in Alaska.

Unless there is a direct action of negligence you cannot blame a head of a company for something that is done by lower level employees. And India was wanting revenge, not justice, I'd do the same if a third world supicious country would be trying to take me just because I'm the foreigner, the "gringo".
This is what happens when big companies start cutting corners for more profits. Same as BP did, loss of human life was cheaper than harsher security. The sad thing is that everyone has to pay when it all goes horribly wrong. What is unacceptable is that they get away with it. They should have to pay for what they did, both with jail time and with big money, hit 'em where it hurts the most and they will think twice about cutting corners in the future.
