As both fighting with katana and kidou are supposed to be skills practiced by Shinigami, using either one in a fight is legitimate. If you notice, Kuchki uses a similar set of tactics against Renji. During that fight, he explains that using kidou is a way of dirupting an opponent who isn't fully in touch with his bankai. This would seem tobe the same reasoning for the tactics against Ichigo, as that is exactly what the lighting and foot stabbing does.

dude i just noticed while watching this today, the cheap move that the captain made on ichigo during the verse before the final chorus. i mean really who stabs someone in the foot and then shoots a bolt of lightning through their shoulder. talk about evil. and he's supposed 2 be one of the good guys.
