Barry Cooper, CEO of http://nevergetbusted.com and KopBusters was retained in this case by Austin Defense Attorney, James Gill. This is one of the worst cases Barry has seen. The handler walked the dog by the driver's door a dozen times before coaxing him to alert by stimulating him with the toy reward. A legitimate alert would have happened the first or second pass at the door. The motorist was illegally arrested for possession of a controlled substance and possession of marijuana.

UPDATE:

The jury was selected and five minutes before the trial started, the prosecutor said he did not want to try the case and offered the motorist time served, no fine and no probation. She took the deal. The meth charge was dropped. This was an illegal search and the prosecutor knew it.

From my experience filming the K9s searching vehicles, it is my opinion that the dog never alerted. After a while the dog will go through the motion to get the reward despite the absence of narcotics, especially when a cop keeps making the dog sniff the same square inch over and over.

@pjds1989 No, the Dog sniff is considered a "Free air sniff" by the federal law. You can refuse it but it dont matter. It does no violate a illegal search because the dog did not go into the vehicle.... Kinda puzzling i know.

Dog looks like it just wants to play and be a dog, jumping up at the driver and wagging it's tail. Smelling the lawn and wagging it's tail. The dog is definately not focused on the task it's supposed to be performing. It's not focused on anything really, it's just bouncing around and wagging it's tail.
