I haven't listened to their solo albums, so I have no idea what song it is...
But this doesn't sound like Dream Theater anyways.
The only thing that 'sounds' like DT here is LaBrie. :)
The chords progression doesn't... At least I think so.

I think that happened with Panic Attack only.
They gave a fake demo to five-six people a few days before the releasing of the album.
It was immediately uploaded to the internet... :)

yep.....great album nonetheless....If I remember correctly this was confused at the time with Octavarium because the release dates were very close to each other and there was some confusion...at least that's what I read on Wikipedia but as you know, Wikipedia isn't exactly the source of all knowledge :)
