the definition of a pirate is "One who robs at sea or plunders the land from the sea without commission from a sovereign nation."

if someone is not committing the act of theft then they do not fit this definition.

It's true, the U.S did use pirates during the American Revolution. It's called "Geure de Course" (I know I spelled it wrong) It means war on commerce. It's typical when a county who has a smaller naval power then its opponent, this strategy is employed. For the most part it didn't have a great effect, but it helped alot during WWII when Japan pulled off Pearl Harbor, and we lost most of our ships.
