    I have a very BASIC question about acquiescence and hidden obligation/clauses and fraudulent contracts:

    You never receive proof or evidence that lender mortgage bank ever put up any value to get deed of trust/Mortgage so how do we get this evidence that a bank actually paid something of value for the Mortgage? Seems possible that the lender is only transfering mortgage whilst collecting fees & interest.

    Wife and I went to bank for help to buy new home last year. We didn't have enough money. Bank made us pay sellers 20% of price. Bank kindly paid sellers remaining 80% on condition we pay them back. We signed note promising to pay and gave bank mortgage deed to "secure" them against our failure to pay. We love our new home and are thankful to our bank. But for bank, we'd still be in old house. Bank gave seller money.

Yes, that scene is my thought too; BUT I never see the $120k+ money or its receipt that the bank (lender) allegedly paid for the mortgage and the previous occupant (seller) of the house only had $20k deposited into her electronic account whilst I've (buyer/debtor) paid over $100k and still owe another $70K...

    Where is the evidence (receipt) of the Bank's payment?

  • @ronmamita ... Why not contact the seller? Surely you wouldn't now be in possession of the property if the seller had not received full payment. Don't you agree?

  • @Jurisdictionary No, I do not agree. I did contact the seller and I know what she received.

    This led me to this question.

    I am exploring how to find the answer and evidence that the bank ever paid anyone(s) near $120,000.00 as was claimed.

  • @ronmamita ... Perhaps the bank paid off the seller's previous mortgage debt? Do you have the HUD statement that was given to you at closing? That will show you who got what at closing.

    you simply must contact the closing firm and request all documents , and you may also track ownership through the local county seat, county clerk records will document all transactions of deeds, this is what the policy workers do and charge for title policy, the bank should have issued you one of these, this is normal in any land purchase, good luck!

  • sounds like the seller was due the 20k and the rest went to pay off their morguage somewhere. You should also have a deed of trust and a notice of morguage, depending on which state you live in. These documents will have been filed also at the country clerks office.

  • Many clerks offices have most of their info onlione now, and most county tax accessors also have this info, they will have the tavable value, who paid the taxes for the last several years, etc, all of this is open knowledge to the public of which anyone may request to view. Such thinsg should always be double cheked before any purchase, customary.
