@Pyrochase good theory...in fact...didn't the merovingian asked for the oracle's eyes in exchange of the return of neo???...maybe he didn't meant from the subway...maybe it was from death...and he'll come back, and the oracle will give him her eyes (he was blind remember?)

The human seen in cinematic 8.3 observing the video of Neo's encounter with the Deux es Machina is the corporeal form of the Intruder.

The "Intruder" is a free-born human, not part of the Zion Resistance or related to any faction of humans that originated from said group. It is likely that he was never plugged in to the matrix, possibly being born naturally in another part of the Real world. His monicker as an "Intruder" supports this notion, as he does not originate with the Matrix, being neither an inherent program or freed human being.

Course if the machines have Neo and think he is controlled he very well could be projecting himself into the matrix again much like he did in the end of Matrix 2. Who knows.

So all in all, there is nothing that says Neo is gone, dead or otherwise, if anything the Oracle and the Legend of the One gives plenty of substance to Neo potentially returning soon . And honestly, do you really think the story writers (the Brothers) would off the best character in their story? Neo represents a messiah figure, and as we know messiah figures typically are superhuman and supernatural in nature and power.

For all we know Neo is being repaired or recreated by the machines, in order to manipulate him to their will, hence the breakage in the treaty/ceasefire. They may think since they have him they can go back to controlling the Matrix. Morpheus did say the Matrix was a system of control and being human we are not bound by the boundaries of the matrix, we simply have to discover what they are.
