Episode 49: I got ANOTHER "Third Party Content" match on YouTube from The Orchard Music.

This ends here.

MANY YouTube users have had problems with Orchard Music making false copyright claims to music on their videos. If you are one of them, here's how you can get in touch with them:

I sent the following email to Orchard Music when this episode aired:

----------
The Orchard Music previously had copyright disputes against the following episodes of my YouTube series, The Pedaling Prince's Podium:

http://www.youtube.com/watch?v=y8cWZeG4IuY
http://www.youtube.com/watch?v=wpYYut0AShs

The first was misidentified at "Beautiful Morning" by Lovers Wedding Band; it was actually "Brandenburg Concerto No. 4 in G, Movement I (Allegro), BWV 1049" performed by Kevin Macleod. The second was misidentified as "La novena maravilla del mundo: los ingresos pasivos" by Raimon Samsó; it was actually "Broadcast News Long" which is included with Apple's GarageBand.

I attempted to dispute the first claim through YouTube; you ostensibly reviewed the episode and still maintained that the music was yours despite the clearly stated Creative Commons license in the episode's end credits. On the second claim I threatened to air an exposé of The Orchard Music; ONLY THEN were the claims removed.

I am aware that you have been subject to multiple copyright disputes on YouTube of late where you insist on taking credit for music that does not belong to you, in some cases laying claim to music on which the UPLOADER THEMSELVES holds the copyright:

In light of that, in the hope that I might help others whom you have done this to, I decided to air my exposé anyway:

This past Tuesday, you had another third party content claim against THIS episode of my series:

Once again, this music is NOT YOURS; it's KEVIN MacLEOD's "SHINY TECH." I even talk about this in the intro to the video, which you'd know if you'd reviewed it; thus far my dispute is still awaiting your review.

Frankly, I'm fed up with Orchard Music's obvious scam. There are too many "false positives" being generated by Orchard Music to be coincidence; the only way this could happen is if Orchard Music deliberately, with full foreknowledge and intent, filed all this public domain and royalty free music with YouTube for automatic ID scanning falsely claiming it.

So this is my response:

  • Kevin MacLeod is aware of it and asks everyone who has been harassed by these clowns to let him know about it.

  • @lonnieljones Yes, I know; he and I have been exchanging emails about all this. :)

  • @PedalingPrince Just finished part one and saw the contact info in your video description. Great and thanks, I will be contacting them to start. My accounts are monetized and they are costing me some money, (small amount but substantial to me). They are as bad as the now-defunct Craze Productions who were claiming to own pretty much every old movie in the public domain. I'll go for their throat, don't know how yet.

  • Copyright fraud, i.e. making a false claim of copyright where none exists, is punishable by fines ranging from $750 to $30,000. There are numerous web sites that explain this, but You Tube won't let me post the URLs. If you want to go after Orchard Music, I suggest a class action suit.

  • Thank you for posting your videos, this has recently happened to me and without your videos I wouldn't have known what to do. Hopefully they'll get their crap of my videos and leave me in peace.

  • has anybody contacted the FBI?

  • Thanks. Any good alternatives?

  • My channel is almost completely old public domain recordings, and Orchard Music has copyright claimed almost every one of them. They're a bunch of bastards and need to be prosecuted for fraud.

  • Orchard Music allegations are baseless, and Google should look into this.

  • Now theres the research I like.

  • To contact The Orchard Music, check out my video: "The Orchard Music Content ID Fraud"

  • @PedalingPrince Good! I hope he, or someone else, puts a stop to their BS!
