  • I'm not familiar with LA's rental control program, so I can't give you any advice concerning program particulars. Baring anything to the contrary in the rental control, the following information accurate. Due to the fact that you are on a month to month residency, the new landlord can terminate the tenancy with a 30 or 60 day notice depending on how long you have resided in the unit. Long story short, you're on a month to month tenancy meaning that either party can terminate at will.

  • We moved into a home 11/09. We signed a 2 year lease, handed over $1450 cash.

    We found out 3 days after we moved in the house was in default and they had not paid their mortgage in 7 months..Is our lease valid? what do we do?

  • I'm assuming that you have a written, signed and acknowledged lease by both parties with a receipt for the money. Then yes your lease is valid. Your lease and the owners mortgage are completely separate agreements. Just because he / she is in foreclosure, does not invalidate the lease. Now what should you do? Answering that question will take more room than what's allowed on this comments page. Call me to discuss.

  • I just got a notice of Lis Pendens on my rental. I've lived here almost 5 years. He owes me last and security. Can I stay here for 2 months rent free? Also, if I am still here after that 2 months, who would I pay rent to, if anyone? Help?

  • First off, where do you live? I can only comment on CA laws. A Lis Pendens is a a written notice that a lawsuit has been filed which concerns the title to real property or some interest in that real property. This is normally done if the property is in escrow. It lets the buyer know that something is up.

    This is a legal dispute between the owner and a third party about the title or ownership of the proeprty. It has nothing to do with your tenancy.

  • I live in Los Angeles and my apartment in rent control. I have a month to month agreement. My place was foreclosed on and the new owners want to evict me. My understanding is that under rent control they can't evict me except for the 12 legal reasons which I'm not breaking. So if they want me out to raise the rent, they can't right?
