U.S. Office of Special Counsel ( OSC) supported TSA Federal Air Marshal Robert MacLean's termination case discussed in congressional hearings. On August 25, 2011, the OSC intervened in MacLean's Merit Systems Protection ( MSPB ) termination case. MacLean was fired for disclosing a July 2003 TSA plan to remove air marshals for nonstop, long distance flights for two months in order to save on hotel costs. The plan was to make up for a budget shortfall caused by private contracts and cash bonuses for TSA managers and executives.

On October 16, 2007, Rep. Bill Pascrell (NJ) asked TSA Administrator Kip Hawley about Federal Air Marshal Robert MacLean's termination. Two years later on July 23, 2009, Rep. Pascrell does not forget about MacLean and other Federal Air Marshal Service whistleblowers.
