The highly conservative court (with far right wingers like Scalia included) at the time reviewing Wisconsin v. Michell unanimously upheld hate crimes laws (usually deemed liberal) as constitutional. The reason they don't impinge on First Amendment rights is that they do not target speech or expression but are, rather, penalty enhancements meaning a crime has to already be in place and only then is motive taken into account so as to be tougher on crime.
